CAREB SRL, an official and authorized distributor of Hoco brand products, with registered office in Via Guseppe Papalia, 10 - 70126 Bari (BA), VAT No. 03896520727, is the owner of www.hocotech.it.
Acceptance of the general conditions of sale
1. The contract entered into between CAREB SRL and the Customer shall be deemed concluded with the acceptance, even partial, of the order by CAREB SRL. Such acceptance shall be deemed tacit, unless otherwise communicated in any manner to the Customer. By placing an order in the various modes provided, he declares that he has read all the information provided to him during the purchase procedure, and fully accepts the general and payment conditions transcribed below.
2. If the Customer is a consumer, once the online purchase procedure is completed, he/she will print or save an electronic copy and in any case keep these general conditions of sale, in accordance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.
3. Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order.
Modalities of purchase
4. The Customer may purchase only the products in the electronic catalog at the time of placing the order and viewable online at (URL) www.hocotech.it, as described in the relevant information sheets. It is understood that the picture accompanying the description sheet of a product may not be perfectly representative of its characteristics but differ in color, size, accessory products present in the picture. All supporting information for purchase (Glossary, Buying Guide, etc...) is intended as mere generic information material, not referring to the real characteristics of an individual product.
5. The correct receipt of the order is confirmed by an e-mail response, sent to the e-mail address provided by the Customer. This confirmation message will contain Date and Time of execution of the order and a 'Customer Order Number', to be used in any further communication with www.hocotech.it. The message will reproduce all the data entered by the Customer, who undertakes to verify their correctness and promptly communicate any corrections, in the manner described in this document.
6. In the case of non-acceptance of the order, CAREB SRL ensures timely communication to the Customer.
Methods of payment
7. Credit card (if listed among the available payment methods)
In cases of purchase of goods with payment method Credit Card, at the same time as the conclusion of the online transaction, the bank of reference will authorize only the commitment of the amount relating to the purchase made. The amount relating to the goods processed, even partially, will actually be charged to the Customer's credit card only at the time of entrusting the courier of the goods, for the material delivery of the goods ordered. In the case of orders containing one or more products with "On Demand" availability, due to long delivery times and the expiration of the Credit Card authorization, the credit card will be charged after the Customer is notified of the expected delivery date and its acceptance by the Customer.
7.1 In case of cancellation of the order, either by the Customer or in case of non-acceptance of the same by CAREB SRL, will be requested simultaneously by CAREB SRL the cancellation of the transaction and the release of the amount committed. The time of release, for some types of cards, depends exclusively on the banking system and can reach their natural expiration date (7th day from the date of authorization). Once the cancellation of the transaction has been made, under no circumstances can CAREB SRL be held liable for any damages, direct or indirect, caused by delay in the failure of the banking system to release the committed amount.
7.2 CAREB SRL reserves the right to charge the customer's credit card in order to avoid the expiration of the transaction authorization, which occurs on the 6th day.
7.3 CAREB SRL reserves the right to ask the Customer for additional information (e.g. landline phone number) or to send copies of documents proving the ownership of the Card used. In the absence of the requested documentation, CAREB SRL reserves the right not to accept the order.
7.4 At no time during the purchase process is CAREB SRL able to know the information relating to the buyer's credit card, transmitted via secure connection directly to the website of the banking institution handling the transaction. No computer file of CAREB SRL will retain such data. Therefore, under no circumstances can CAREB SRL be held responsible for any fraudulent and undue use of credit cards by third parties, when paying for products purchased on www.hocotech.it.
7.5 To compensate for the costs of handling Credit Card payments, charged to CAREB SRL by the banking institution / payment gateway, CAREB SRL may charge its Customers a small surcharge.
8. Cash on Delivery
In case of Cash on Delivery purchase, an additional fee will be applied to the total amount, clearly highlighted when choosing the payment method. Payment must be made exclusively in the following ways:
- with cash;
- by CIRCULAR check payable to CAREB SRL;
- by BANK check made payable to CAREB SRL, if authorized by CAREB SRL.
The communication to the Customer of which courier will be in charge of the delivery will be made in the manner provided on the site. Nothing more than what is indicated at the time of the order will be due from the Customer.
9. Advance Bank Transfer
In case of payment by bank transfer in advance, what was ordered by the customer will be kept committed until receipt of proof of transfer, to be sent to CAREB SRL (by fax or e-mail) no later than 3 working days from the date of acceptance of the order. The shipment of what has been ordered will take place only when the actual crediting of the amount due on the account of CAREB SRL, which must take place within 7 working days from the date of acceptance of the order. Beyond these deadlines, the order will be deemed automatically canceled.
The reason for the bank transfer must state:
- the reference number of the order;
- the date the order was placed;
- first and last name of the order holder.
Methods and costs of delivery
10. CAREB SRL will accept orders with delivery in the Italian and European territory (in the countries provided). However, delivery to the localities of Livigno and Campione d'Italia is excluded.
The cancellation of the order is possible until the moment of order fulfillment, which occurs with the issuance of the transport document. The status of the order is also visible in the customer's history.
11. For each order placed by companies with VAT at www.hocotech.it, CAREB SRL issues an invoice for the material shipped, sending it by e-mail to the order holder, in accordance with art 14 D.P.R. 445/2000. For the issuance of the invoice, the information provided by the Customer at the time of the order shall prevail. No change in the invoice will be possible, after the issuance of the same.
For sales to private consumers of goods negotiated via the Internet applies the regulations provided for distance sales (mail order type sales) and therefore there is an exemption from the issuance of the receipt or tax receipt, with the obligation to issue the invoice only upon request by the consumer (see circ.Min. Fin. 97/E of April 4, 1997).
12. Delivery costs are the responsibility of the Customer and are clearly explained in the order confirmation. The payment of the goods by the Customer will be made using the method chosen when placing the order. The Customer shall recognize the amount related to delivery costs in addition to the total amount of the order highlighted at the end of the purchase process. It reserves the right to offer promotions on shipping costs, for example the formula "free shipping upon reaching a certain order amount". Any promotions will be made very clear and publicized on the site.
13. No responsibility can be attributed to CAREB SRL in case of delay in the processing of the order or delivery of what has been ordered.
14. Delivery of what has been ordered shall be understood to be at street level except:
- different communication from our customer service
- what is provided in the product data sheet
- the explicit purchase of delivery to the floor, where applicable
Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages being delivered corresponds to the number indicated in the transport document anticipated by e-mail;
- that the packaging is intact, not damaged, nor wet or otherwise altered, including in the sealing materials (adhesive tape or metal strapping).
For fragile or valuable items (such as spare parts/displays), shipment insurance is recommended, which involves a small surcharge.
Package insurance is optional; if it is not required, the seller will not assume responsibility for loss, theft or damage to the package. The parcel will travel under the responsibility of the buyer and the seller will be released from any obligation from the time of delivery to the carrier. Standard insurance covers up to a value of €500. For higher values of the goods, an additional charge may be required. If the shipment is not insured, the risks associated with transportation are the responsibility of the buyer.
We inspect each item before each shipment, so we are not responsible for damage, loss, theft or tampering that occurs during transport.
Any damage to the packaging and/or product, or mismatch in the number of packages or markings, must be immediately disputed by affixing WRITTEN CONTROL RESERVE (SPECIFYING THE REASON FOR THE RESERVE, e.g., "punctured packaging," "crushed packaging," etc.) on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 2 days of delivery, in the manner provided herein.
15. In the event of failure to collect within 5 working days of the material in storage at the warehouses of the courier due to repeated inability to deliver to the address specified by the customer when ordering, what was ordered will be returned to the warehouses of CAREB SRL
Right of withdrawal
16. Pursuant to art. 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who buys goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to www.carebsrl.it a reference to VAT), has the right to withdraw from the purchase contract for any reason, without explanation and without penalty, except as indicated in paragraphs 18 and 20 below.
17. To exercise this right, the customer must send www.hocotech.it a communication to this effect, within 10 working days from the date of receipt of the goods. Such notice must be sent by registered letter with acknowledgment of receipt, addressed to.

or by telegram or fax always sent within the aforementioned period of 10 days and followed by a confirmation by registered letter with acknowledgment of receipt, sent STRICTLY within the next 48 hours. Once we receive the above notice of withdrawal, Customer Service www.hocotech.it will quickly notify the customer instructions on how to return, assigning a unique RMA code for the return of the goods, which must be received by CAREB SRL within 10 days of authorization.
The goods must be returned undamaged, unused, complete with all its parts and in the original packaging (envelopes and packages), in accordance with the conditions of the following points 18 and 20.
18. However, the right of withdrawal is subject to the following conditions:
- the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, attached software, etc...);
- the right does not apply to sealed audiovisual products or computer software (including those attached to hardware), once opened;
- the purchased goods must be undamaged and returned in original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ...); to limit damage to the original package, we recommend that it is placed in a second box, on which to affix the label provided by CAREB SRL, bearing the RMA number (return authorization code); should be avoided in all cases the attachment of labels or adhesive tapes directly on the original packaging of the product;
- In accordance with the law, the shipping costs related to the return of the good shall be borne by the customer; delivery costs to the customer and any other incidental expenses highlighted at the time of placing the order will also not be reimbursed;
- the shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer;
- in case of damage to the property during transport, www.carebsrl.it will notify the customer of the incident (within 5 working days of receipt of the goods in their stores), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the property (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
CAREB SRL is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;
upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged, CAREB SRL will deduct from the refund due a percentage, but no more than 10% of it, as a contribution to the costs of restoration.
19. Without prejudice to any repair costs for damages assessed to the original packaging, CAREB SRL will refund the customer the amount already paid for the purchase of the goods, within 14 days of its return, by transfer of the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (ABI - CAB - Current Account of the invoice holder).
20. The right of withdrawal is totally forfeited, for lack of the essential condition of integrity of the property (packaging and / or its contents), in cases where CAREB SRL ascertains:
- the use, even partial, of the good and any consumables;
- the lack of the outer packaging and/or the original inner packaging;
- the absence of integral elements of the product (accessories, cables, manuals, parts, ...);
- damage to the product for reasons other than its transport.
In the case of forfeiture of the right of withdrawal, the goods will remain at the headquarters of CAREB SRL, available to the Customer for collection at His expense.
Guarantees
21. All products sold on www.hocotech.it are covered by the conventional manufacturer's warranty and 24-month warranty for conformity defects, pursuant to Legislative Decree 206/05. To benefit from warranty service, the Customer must keep the sales note or invoice that he/she will receive by e-mail in electronic PDF format.
Exercise of the Warranty may involve requesting assistance from authorized service centers in the territory and/or follow the procedures outlined in the documentation inside the product packaging.
22. The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect turns out not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration required by the Authorized Service Center, as well as transportation costs, if incurred by CAREB SRL.
23. The 24-month warranty under Legislative Decree 206/05 applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in accordance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private Consumer (natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a reference of VAT). In case of lack of conformity, CAREB SRL provides, without cost to the customer, the restoration of conformity of the product by repair / replacement or reduction of the price, until the termination of the contract. If, following intervention by an Authorized Service Center, the defect does not result a lack of conformity pursuant to Legislative Decree 206/05, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as the costs of transportation if incurred by CAREB SRL.
24. Replacements in case of DOA (Dead On Arrival: product not working on delivery) occur only if expressly provided by the manufacturer. The timing of replacement or eventual repair of the product depends exclusively on the manufacturer's policies.
25. In the event that, for any reason, is unable to return to its customer a product under warranty (restored or replaced), CAREB SRL may proceed at its own discretion to refund the amount paid taking into account the use of the asset or its replacement with a product of equal or superior characteristics.
26. The timing of repair or eventual replacement of the product depends exclusively on the policies of the manufacturer and no damage can be claimed to CAREB SRL for any delay in making repairs or replacements.
27. In cases where the application of warranties provides for the return of the product, the property must be returned by the customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ...); to limit damage to the original package, we recommend that it be placed in a second box; it should be avoided in all cases the attachment of labels or adhesive tape directly on the original product packaging.
The Customer will be provided with an authorization number for the return of the product (RMA) which must be indicated on the outside of the packaging, following the instructions provided directly in the relevant authorization e-mail.
Privacy
28. The personal data requested when placing the order are collected and processed in order to meet the express requirements of the Customer and will not under any circumstances and for any reason be transferred to third parties. CAREB SRL guarantees its customers compliance with the regulations on the processing of personal data, governed by the Privacy Code under DL 196 of 30.06.03.

Complaints
29. Any complaints should be addressed to CAREB SRL, Via Giuseppe Papalia 10 Bari (BA).
Applicable law
30. The contract of sale between the Customer and CAREB SRL is concluded in Italy and governed by Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the court of Bari.
Mail order sales to private individuals
31. For sales to private consumers of goods negotiated via the Internet, the regulations provided for distance sales (mail order type sales) apply, and therefore there is an exemption from the issuance of a receipt or tax receipt, with the obligation to issue an invoice only upon request by the consumer (see Circ.Min. Fin. 97/E of April 4, 1997).
